• How long does a personal injury claim take?

One of the most common questions we hear from clients is: “How long will my personal injury case take?”. While every case is different, understanding the typical steps and timelines involved can give you clarity and peace of mind.

Here’s what you can expect from the settlement process.

Step 1: Liability investigation (0–3 Months)

After you report the accident and we file the claim, the first step is determining who is legally responsible. This involves gathering evidence such as witness statements, police reports, medical documentation, and possibly expert opinions.

If the opposing party accepts liability quickly, your case can move forward without delay. If liability is disputed, this step can take longer.

Step 2: Medical assessment & recovery period (variable)

Before the value of your claim can be determined, your medical condition must be stable. This is known as reaching maximum medical improvement (MMI). In simple cases, this may happen within a few months. In complex cases—especially with long-term injuries—this can take a year or more.

During this time, we work with medical professionals to assess the full extent of your injuries, both physical and psychological.

Step 3: Damage calculation (1–2 months)

Once your condition has stabilised, we begin calculating your total damages. This includes:

    • Medical costs (past and future)

    • Loss of income

    • Pain and suffering (smartengeld)

    • Travel expenses

    • Costs for domestic help or adjustments to your home

We then send a formal settlement proposal to the liable party or their insurance company.

    Step 4: Negotiations (2–6 months)

After the proposal is submitted, negotiations begin. Sometimes insurers respond quickly and fairly. In other cases, there may be back-and-forth discussions to reach a reasonable amount. We always keep you informed and consult with you before accepting any offer.

    Step 5: Settlement or lawsuit

If both parties agree on the compensation, the case is settled, and payment usually follows within a few weeks.

If no agreement is reached, we may advise taking the matter to court. This adds time and complexity, but in some cases, it’s necessary to get what you’re entitled to.

Average duration: 6 to 18 months

Most personal injury claims in the Netherlands are settled within 6 to 18 months. Complex cases or those involving serious injuries can take longer, especially if court proceedings are needed.
