Fell from your bicycle because of a road defect: can you claim?
A pothole or damaged cycle path can raise different liability questions from a collision. Learn what evidence helps establish a claim.
A road defect is a different type of claim
When there is no other vehicle involved, there may be no motor insurer to contact. The starting point is usually to identify who manages the surface: a municipality, province, another public body or a private owner. That responsibility should be checked for the exact location rather than assumed from the nearest street sign.
A public road need not be perfectly smooth in every place. A claim may depend on the depth and position of the defect, how visible it was, the expected use of the cycle path and whether warnings or practical precautions were needed. Temporary building works can introduce another responsible party.
Record the defect before it disappears
Take photographs from the direction you approached, as well as close-ups that show scale. Include lighting, road markings, barriers and the route available around the obstruction. Only do this when it is safe. A witness who saw the wheel catch or the fall itself can be particularly useful.
Report the location accurately and retain the reference number. A repair shortly afterwards does not automatically prove liability, but it can make early photographs important. Keep the bicycle for inspection if a damaged wheel or component helps explain what happened.
Separate the cause from the consequences
An adviser will need both an account of the fall and evidence of injury-related loss. Medical appointments, missed work and repair invoices answer different questions. A council’s maintenance records may also matter; you do not need to have every document before asking for help.

Avoid assuming that every fall has a liable party
Loose gravel, poor weather, rider behaviour and equipment condition may be disputed. Explain inconvenient details as well as those that support your claim. If symptoms or income loss continue, organise a clear evidence file so the practical impact is not lost while liability is investigated.

A cyclist photographs an uneven section of cycle path on the day of a fall. When they return a week later, the surface has changed. Their original wide-angle images show the location, while closer images help record the condition at the time.
Practical takeaway: Preserve dated original photographs and any report reference. A later repair does not by itself establish responsibility for the earlier accident.

Does a council repairing the path mean it admits fault?
No. A repair may remove a hazard without admitting legal liability for an earlier incident. The original condition and the circumstances still need to be assessed.
What if nobody saw the fall?
A claim is not automatically excluded. Photographs, prompt reporting, the damage pattern and consistent medical records may help, although proving how the accident happened can be harder.
