What is smartengeld in a Dutch personal injury claim?
Smartengeld concerns non-financial harm. Understand how it differs from expenses and why there is no universal accident payout.
Financial and non-financial loss are different
Treatment expenses and missed earnings can often be shown in money records. Smartengeld addresses another part of the impact: pain, loss of independence, scarring and limitations in everyday life. The same injury can affect people differently depending on its severity, duration and consequences.
This distinction does not mean any upsetting event automatically produces a separate award. The legal basis and proof of the relevant harm still need to be established.
Describe ordinary life in concrete terms
Explain disrupted sleep, activities you cannot do, ongoing discomfort and the effect of visible injury. A factual recovery diary can help when the claim is assessed months later. Avoid exaggeration or trying to match another person’s account simply because their compensation was higher.
Medical information provides context. If psychological symptoms persist, discuss them with an appropriate healthcare professional; a diary does not substitute for diagnosis or treatment.
Why comparison amounts are only a guide
Advisers may look at comparable Dutch cases and relevant guidelines. The comparison should consider the injury and its course, not merely the accident type. Figures from another country may reflect a different legal system and are not automatically suitable for a Dutch claim.

Include the whole compensation picture
A headline smartengeld figure should not distract from significant income or care losses. Ask which part of an offer relates to pain and suffering and which part relates to financial damage. If they are bundled together, request a breakdown.
