Truck accident evidence: what should be preserved early?

Truck claims may involve a driver, operator, trailer owner and foreign insurer. Preserve the details that connect them to the collision.

One vehicle can involve several organisations

A company name on the trailer may not identify the driver’s employer or the insurer of the tractor. Photograph number plates and visible business details where safe. Record the driver’s contact and insurance information without relying only on a logo.

Consider records that may be time-sensitive

Dashcam recordings, nearby security footage and driver or company reports may clarify the route and manoeuvre. Depending on the circumstances, tachograph information, vehicle inspections or loading documents can also be relevant. A tachograph records information including driving and rest periods; it is not a complete video reconstruction.

Ask an adviser which records should be preserved and who holds them. A claimant is not automatically entitled to all commercially sensitive information. A focused request identifying the vehicle, date and disputed issue is more useful than a demand for every company document.

Keep the road layout in context

Wide photographs can show lane markings, cycle lanes, sightlines and the space available for turning. A blind spot allegation needs assessment of the actual positions and movement of the vehicles. A collision with a truck is not resolved simply by saying that the truck is heavier.

A nearby shop has a camera facing the junction, while photographs show the vehicles only after they were moved. The shop footage and the original photographs may help distinguish the sequence from its aftermath. Neither account should be treated as proved simply because it was given first.

Practical takeaway: Record the time and location precisely, identify potential footage and ask promptly for it to be preserved. A preservation request is not a guarantee that the footage exists or that you can obtain it.

Can I obtain the tachograph data myself?

You can ask for relevant records to be preserved, but access may require the cooperation of the operator or a legal process. Discuss which data would actually help the disputed issue.

Does a foreign registration mean I cannot claim in the Netherlands?

Not necessarily. The accident location, responsible parties and insurance arrangements need to be assessed. Do not assume the company printed on the trailer is the correct insurer contact.
